第八条由于双方的劳动聘用关系，乙方将有机会了解并使用甲方的有关商57

业秘密(包括但不限于经营策略、软件系统、薪酬系统、营销渠道、员工或客户58

资料、供应商、价格系统、知识产权等所有资料及文件)，乙方有在协议期内及59

协议解除后保守甲方商业秘密不对外泄露的义务，也不能用于为自己谋取利益60

的经营活动中。乙方不得将涉及甲方商业秘密的实物、文字材料、电子文档等61

以窃取、摘抄、复制、传真、拍照、电子邮件等方式占有、传播、出售、使用62

或允许他人使用甲方的商业秘密。本条款所规定行为，乙方如有违反，应向甲63

第九条乙方有下列情形之一的，甲方可以解除本协议，但是应当提前十日76

⑴患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方

第十条乙方有下列情形之一的，甲方可以单方面随时解除协议，并对乙方96

第十一条乙方解除协议，应当提前三十日以书面形式通知甲方。Second 127

第十二条甲乙双方约定无论何种情形解除协议，乙方都对工作交接负有责130

任，须按甲方规定的程序进行工作交接。乙方不按甲方的规定交接工作的，甲131

方有权扣发乙方服务费;乙方不按规定交接工作致使甲方遭受损失时，甲方将依132
