甲乙双方根据《中华人民共和国劳动合同法》(以下简称《劳动合同法》)和国家、省市

的有关规定,遵循合法、公平、平等自愿,协商一致、诚实信用原则,订立本合同。

The two parties conclude the contract under the guidance of <

China on Employment Contracts>> and the relevant regulations released by State, Province and City governments complying with the principles of lawfulness, fairness, free will, reaching consensus through consultation, good faith.

一、劳动合同期限Term of The Contract

(一)合同期限

双方合同期为年,即从年月日起至年月日止,其中试用期为月。在试用期内,乙方被证明不符合录用条件的,甲方有权随时解除劳动合同。所谓试用期不符合录用条件包括:

During the probationary period, if the employee is proved unsatisfied, the employer can terminate the contract any time. What called unsatisfied herein includes items listed below:

(1)乙方在日前未能完备所规定的手续的;

The employee does not finish the required procedure within___day(s).

(2)乙方不能达到所担任岗位的绩效指标或者相应的要求的;

The employee is not able to meet the requirements of the position.

(3)乙方在试用期内请假次数超过《员工手册》上所规定的或者迟到早退超过3次的;The times of the employee asking for leaving during the probationary period exceed the limited listed in the, or more than three times of being late for work and/or leaving early.

(4)乙方的背景调查或者在履历中发现有弄虚作假行为的;

The employee is found fraud in the investigation of background and resume.

(5)乙方顶撞上司或在工作期间发生殴斗行为的;或者其他任何主管认为乙方不能符合该职位的要求的;

The employee contradicts supervisors or has behavior of fighting during the work time, or other things that supervisors do not think satisfy the requirements of the position.

二、工作内容Job Content

1、乙方被招(聘)为甲方的部门,担任工作,乙方须按照甲方确定的岗位

责任,按时、按质、按量完成工作。

The employee has been hired to work in the_____________department as _____________, the employee needs to work as what stated in <>.

2、乙方的具体工作及操作由直属上司向其讲解和分配。

The employee’s job tasks are to be assigned and explained by his/her direct supervisor.

3、甲方因生产经营需要或乙方的能力及表现确可胜任,在内部部门或岗位之间可作临

时性、有确定期限的调动或派外工作或变更乙方的工作,乙方有反映本人意见的权

利。

According to the need of manufacture or the capacity of the employee, the employer can transfer the employee among different departments or positions, or let him/her work outside, or change his/her position for a certain period of time. The employee has the right to discuss the matter with the employer.

三、工作时间和休息休假Working Time and Holidays

1、实行每周工作5天(40小时),休息2天的工作制度。

The employee has an irregular working time.

2、甲方确因生产经营情况需要乙方加班时,乙方应积极配合,加班工资按有关法律、法规规

定执行。如未经公司同意私自加班,将不予计发加班费。

3、甲方执行法定的及企业依法自行补充的有关工作、休息、休假制度,按规定给予乙方享受

节日假、年休假、婚假、丧假、产假、看护假等带薪假期,并按本合同约定的正常工作时间工资及有关政策法规规定的计算方法支付工资。

The employer will offer the employee leaves with normal pay for festival leave, annual leave, marriage leave, funeral leave, maternity leave, maternal care leave according to the government laws and the company regulations.

四、劳动报酬Remuneration of Labor

1、甲方工资制度,乙方的工资为人民币元/月。

2、按_ _元/月为基数计发加班费。

3、乙方的工资水平、奖金、津贴,按甲方有关规定执行。

The employee’s salary level, award and allowance are executed according to the employer’s regulations.

4、每月10-15日,甲方以银行转帐的形式付给乙方上月工资。

The employee shall be monthly paid by bank transfer by the employer during 10th-15th for the last month payment.

5、甲方必须按照当地政府规定或劳动合同的约定,以货币形式按时、足额地支付乙方的工资。The employer shall pay the employee by currency without shortage in accordance with the local governmental regulations or stipulations in this labor contract.

6、甲方将从乙方总收入中扣除应付的个人所得税,并代交个人所得税。

The employer will deduct the income tax directly, and submit to the authorities for the employee.

7、乙方在合同期的工作期间,甲方根据乙方在工作岗位上的表现,有权提升、降职或依法调

动乙方的工作岗位,甲方并根据新的工作岗位性质所对应的工资标准执行支付乙方工资。During the period of the contract, the employer has the right to give the employee promotion, demotion, or change the employee’s position, and as consequence the employer might change the salary according to the employee’s new position and it’s payment policy.

五、社会保险Social Security

(1)甲乙双方按照国家和省、市有关规定,参加社会保险,缴纳社会保险费,乙方依法享受相应的社会保险待遇。

Both parties take part in the social security programs in accordance with relevant state, provincial and city regulations by depositing money to the special account. The employee is granted by law the socail security treatments.

(2)乙方患病或非因工负伤,甲方应按国家和地方的规定给予乙方医疗期和享受医疗待遇,并在规定的医疗期内支付病假工资或疾病救济费。

In case the employee is sick or get injury due to non-business, the employer shall grant the employee time for medical treatment, and pay the employee during the period of medical treatment or provide the employee with disease relief.

(3)乙方患职业病、因工负伤或者因工死亡的,甲方应按国家和省市的工伤保险法律法规的规定办理。

If the employee has occupational disease,or gets injury or dies due to business, the employer will pay the employer in accordance with relevant state, provincial and city regulations.

六、劳动保护、劳动条件Working Protection & Working Conditions

(1)甲方按国家和省、市有关劳动保护规定为乙方提供符合国家劳动卫生标准的劳动作业场所,切实保护乙方在生产工作中的安全和健康。

The employer should provide the employee with occupational safety and health conditions confirming to the provisions of the state.

(2)甲方按国家有关规定,发给乙方必要的劳动保护用品,并按劳动保护规定每年免费安排乙方进行体检。

The employer will provide the employee necessary articles of labor protection to guarantee the safety and health of the employee confirming to the provision of the state, and offer a free of charge medical check-up each year.

(3)如甲方违章指挥、强令冒险作业危及人身安全的,乙方有权拒绝,并可以随时解除本劳动合同。对甲方及其管理人员漠视乙方安全和健康的行为,乙方有权要求改正

并向有关部门检举、控告。

The employee can refuse to obey the employer and terminate the employment contract immediately if

the employer instructs in violation of rules and regulations and forces the employee to do some dangerous operations. Toward the behaviour from the employer and its management staff disregarding the safety and health of the employee, the employee has the right to ask the employer to change their behaviour and report this to the government or sue the employer.

七、劳动合同的变更、解除、终止Modification and Termination of the Contract

(一)符合《劳动合同法》规定的条件或者经甲、乙双方协商一致,可以变更劳动合同的相关内容或者解除固定期限合同、无固定期限合同和以完成一定工作为期限合同。

In accordance with <> or after the discussion from both sides, the content of the employment contract can be amended or the contract can be terminated.

(二)除因乙方不能胜任工作,甲方可以依法适当调整其工作内容外,变更劳动合同,双方应当签订《变更劳动合同协议书》。

Excluding the situation that the employer changes the job content according to the law for the unsatisfying work performance of the employee on the old job,<> must be signed for any changes of the employment contract.

(三)《劳动合同法》规定的终止条件出现,终止本劳动合同。

In accordance with contract termination conditions of <>, the contract can be terminated.

(四)乙方应遵守国家的各项法律、法规,遵守甲方依法制定的各项规章制度和劳动纪律,服从甲方的管理和教育。乙方严重违纪或违反厂规,甲方可立即解雇乙方,并终止本合同。The employee must abide by the government laws and any lawful regulations conluded by the employer, and obeys the employer’s management. If the employee seriously violates the above laws and regulations, the employer can immediately terminate the employment contract.

八、经济补偿金、医疗补助费的发放Economic Compensation and Medical Treatment Grant 解除或者终止本合同,经济补偿金、医疗补助费等发放按《劳动合同法》和国家、省、市有关规定执行。

On the termination of the contract, the economic compensation and medical treatment grant will be paid in accordance with <> and the relevant state, provincial and city provisions. 九、通知和送达Notice and Delivery

甲乙双方在本合同履行过程中相互发出或者提供的所有通知、文件、文书、资料等,均可以当面交付或以本合同所列明的通讯地址履行送达义务。一方如果迁址或变更电话,应当及时书面通知另一方。

Both sides might submit notices, documents, information, etc by hand or send them to the address listed

in this contract. Either should notice the other side in time in case address or telephone changes.

十、因履行本合同发生纠纷的解决办法Dispute Solution

乙方认为甲方侵害自己合法权益的,可以先向甲方提出,或者向甲方工会反映,寻求解决。无法解决的,可以向就近的劳动行政部门投诉。属双方因履行本合同发生争议,应当先协商解决;协商不成的,可自争议发生之日起30日内向甲方劳动争议调解委员会申请调解,或者60日内向劳动争议仲裁委员会申请仲裁。

If the employee considers that his/her lawful right is violated by employer, he/she can first discuss with the employer or the trade union for solution. If without settlement, the employee can complain to the government labor administration department. Both sides should consult with each other first on contract disputes; For unsuccessful settlement, the employee can apply for intermediation from the employer’s Labor Dispute Intermediation Committee within 30 days since the dispute happens, or the employee can apply for arbitration from Labor Dispute Arbitration Committee within 60 days.十一、本合同的条款与国家、省、市的新颁布的法律、法规、规章不符的,按新的法律、法规、规章执行。

If the provisions in this contract have conflicts with new issued laws from state, province and city, the employment contract must be carried out according to new issued laws.

十二、双方需要约定的其他事项Other matter agreed by two sides

《员工手册》及公司发布的各项规章制度作为本合同的附件,具有相同的法律效力。

十三、此合同一式两份,双方各持一份,均具有同等法律效力。

The contract is in duplicate. Both parties hold one copy, which has the same legal effect.
