PART A) GENERAL 总论

1. Project Background 项目介绍

The name of the Project is Nexans (Suzhou) Cable Solutions Co., Ltd Special Type Cables Product Project and this Contract is for execution and completion of perform Fire Protection Works.

本项目名称为耐克森(苏州)线缆系统有限公司特种电缆生产项目,而本合同针对实施及完成本项目中的消防施工工程。

2. Qualification Requirements 资格审查要求

Prequalification system will be applied for Pre-qualification stage of selection of the process

contractor to execute the contract for Nexans (Suzhou) Cable Solutions Co., Ltd Fire Protection Works. (Already done)

耐克森(苏州)线缆系统有限公司特种电缆生产项目消防工程对投标人在选择初期采用资格预审方式。(已完成)

2.1 To be eligible for award of contract, bidders shall provide evidence satisfactory to the Owner

of their capability and adequacy of financial technical and production resources effectively to

carry out the Contract. The required information includes:

为了能够有资格获得合同,各投标人应向业主提供证明其合格性以及能有效地实施合同的能力

和充分地资源,为此,所有提交的投标书应包括下列资料:

2.1.1 Copies of original documents defining the constitution or legal status, place of

registration and principal place of business of the company, firm or partnership or,

if a joint venture, of each party thereto constituting the bidder;

确定商业公司,商行或合伙公司的构成,法律地位,登记地点和主要所在地的原始

文件的复印本,若是联合体,则提供投标人组成的每一成员的上述资料;

2.1.2 Details of the experience and past performance of the bidder (or of each party to a

joint venture) on works of a similar nature within the past five years, and details of

current work in hand and other contractual commitments;

投标人或(联合体的每一成员)在过去五年在同类性质的工程中的经验和以往成绩

的详细资料,目前手头工作的详细资料以及所承担的其他合同;

2.1.3 The qualifications and experience etails of of key personnel proposed for

administration and execution of the Contract, both on and off site;

不论在否现场的管理实施合同的关键人员的资格和经验;

2.1.4 Details of major items of Contractor's equipment proposed for use in carrying out

the Contract;

在合同的执行中拟用的施工设备和装置的主要项目;

2.1.5 Information regarding any current litigation in which the bidder is involved.

投标人当前介入的有关诉讼的资料;

3. Cost of Bidding 投标费用

3.1 The bidder shall bear all costs associated with the preparation and submission of his bid and

the Owner will in no case be responsible or liable for those costs, regardless of the outcome

of the bidding process.

投标人应承担为投标准备和交标有关的一切费用,而业主不管其投标结果如何,将在任何情况

下不承担或不支付这些费用。

4. Site Visit 现场查勘

4.1 The bidder shall visit and examine the Site of the Works and the surroundings in order to

obtain for himself on his own responsibility, all information that may be necessary for

preparing the bid and entering into a contract. The costs of visiting the Site shall be at the

bidder's own expense.

投标人应查勘和考察工程现场及周围环境,并由其负责获得投标准备和缔结合同所需的全部

资料,有关查勘的费用应由投标人承担。

4.2 The bidder and any of his personnel or agents will be granted permission by the Owner to

enter upon his premises and lands for the purpose of such inspection by prior

arrangement.

业主将同意投标人和其委派的任何人员或代表进入业主的房产和土地, 进行预先安排妥的查

勘。

4.3 The bidder or his official representative shall attend a site visit which will convene at

Wusongjiang Science and Technology Industrial Park, Wuzhong district, Suzhou.

投标人或其正式代表应参加现场踏勘活动,地点为苏州市吴中区吴淞江科技产业园。

4.4 The purpose of the site visit is to allow bidders to inspect the site to confirm existing

conditions.

现场踏勘的目的在于提供给投标人考察现场并确认现状的机会。

5. Content of Bid Documents 招标文件内容

5.1 The set of documents issued to bidders for the purpose of bidding comprises the

following, together with any addenda issued in accordance with Clause 7:

5.2 The set of tender documents issued to bidders for the purpose of bidding comprises any

addendum issued in accordance with Clause 7.

向通过资格预审的投标人颁发用于投标的整套招标文件应包括本须知7条款规定的任何补遗

件。

5.3 Bidder shall get bid document from EPCM Consultant freely. Sub-contractors,

manufacturers, suppliers and others who require copies of the documents shall not request

them directly from the EPCM Consultant but shall obtain them only from bidders.

投标人可免费从项目顾问处获得招标文件,分包商、制造商、供应商及其他需要文件复印本

不应直接向项目顾问提出要求,但可以从投标人处获得。

5.4 The geo-technical report will be available for viewing by bidders at the EPCM Consultant’s

office.

完整的地质勘察报告可在项目顾问办公室阅览。

5.5 The bidder is expected to examine carefully all instructions, conditions, forms, terms,

specifications and drawings in the bid documents. Failure to comply with the requirements

of bid submission will be at the bidder's own risk. Bids which are not substantially

responsive to the requirements of the bid documents will be rejected.

投标人应仔细阅读招标文件的全部说明、条件、格式、技术规范及图纸,不能遵守招标文件

要求的标书将由投标人负责,不能实质性响应招标文件要求的标书将不予受理。

6. Clarification of Bid Documents 招标文件的澄清

6.1 The prospective bidder, after receiving the bid documents, shall check the documents

carefully, and if any parts are missing, or any information is illegible, the bidder shall

immediately notify the EPCM Consultant, who will respond within three days of receiving

such notification by sending the required information to the prospective bidder. Any

consequence of the bidder's omission to notify the EPCM Consultant that pages are

missing or information is illegible will be considered the fault of the bidder and any claim

arising there from will be rejected.

投标人收到招标文件时应仔细检查文件页数和图纸张数,若发现任何文件页数的遗漏,任何

资料词义含混或意义不清,应立即通知项目顾问,他将在收到此类通知后的三天内,将所需

资料邮寄投标人,如果投标人不按上述要求通知项目顾问,则文件有遗漏、资料含义不清而

造成的后果,应作为投标人的过失,其申诉不予受理。

6.2 The EPCM Consultant will respond in writing or E-mail to any queries from bidders which is

received before deadline of queries submission. The response (including an explanation of

the query, but without identifying the source of the inquiry) will be sent to all bidders who

have obtained the bid documents.

项目顾问在疑问提交截止日期前收到的投标人提出的疑问,将以书面或电子邮件形式予以答

复,该答复(包括质询的解释,但不注明质询的来源)将被送至所有已获得招标文件的投标人。

7. Amendment of Bid Documents 招标文件的修正

7.1 At any time prior to the deadline for submission of bids, the EPCM Consultant may, for any

reason, whether at its own initiative or in response to a clarification requested by a

prospective bidder, modify the bid documents by the issue of an Addendum.

在截标期之前的任何时候,不论出于项目顾问主动或未来的投标人的要求,项目顾问可通过

补遗的方式进行修改。

7.2 The Addendum will be sent in writing/fax or E-mail to all prospective bidders who have

received the bid documents and will be binding upon them. After receiving the addeudums,

bidders shall promptly acknowledge receipt thereof by fax to the EPCM Consultant.

补遗应以书面/传真或电子邮件的方式发送至所有已获得招标文件的投标人,该补遗通知与招

标文件对投标人具有相同的约束,收到补遗后投标人应迅速以传真通知项目顾问补遗通知业

已收到。

7.3 In order to afford prospective bidders reasonable time in which to take an Addendum into

account in preparing their bids, the EPCM Consultant may, at the Owner's discretion,

extend the deadline for the submission of bids in accordance with Clause 19.

为了给未来的投标人在其准备投标书时有合理的时间来考虑补遗条款,项目顾问可按业主的

意图,并按照第19条款的规定,酎情延长标期。

PART C) PREPARATION OF BIDS 投标准备

8. Language of Bid 投标书语言

8.1 The bid prepared by the bidder shall be in both the English and Chinese languages.投标书

宜以中文及英文两种语言编制.

Drawings show the bidder's proposed layout of workshops, warehouses,

storeyards, offices, including major installation machinery.

9.2.3 Construction Quality Plan, including construction document management plan 施工

9.2.13 Design Proposal (If any) 深化设计方案(如有)

9.2.14 Sample(if any)样品(如有)

At the completion of the bid evaluation stage the preferred bidder will be required to

submit samples of the materials and equipment proposed to be incorporated into

the Works.最可能中标的投标者将被要求提供材料及设备的样品。

10. Bid Prices投标价格

10.1 The bidder shall complete the Form of Bid and the Bill of Quantities furnished in the bid

documents. Unless explicitly stated otherwise in the bid documents, the Contract shall be

for the whole of the Works as described in the technical specifications and drawings.

投标人应完成投标文件中提供的投标表格和工程量清单。除非在招标文件中另有明确说明,

合同应指技术规范和图纸中所述的整个工程而言。

10.2 The bidder shall fill in rates and prices for all items of work described in the Bill of

Quantities. Items against which no price is entered by the bidder will not be paid for by the

Owner when executed and shall be deemed covered by the other prices entered in the Bill

of Quantities.

投标人应填写工程量清单中所有工程项目的单价和价格,对于投标人未填写的项目,在履约

时,业主将不予支付,并认为已包括在工程量清单中的其它项目中。

10.3 Rates and prices indicated by the bidder in the Bill of Quantities shall be fixed during the

performance of the Contract. Quantities should be calculated based on drawings; the

bidders should be responsible for his quantities fault. Other than drawings’ adjustment,

fixed total price should be applied to this project.

在履行合同时,所有投标人在投标时所报的单价和价格将是固定的。投标人所计算的工程量

要以图纸为准,漏算或少算,投标人自行承担;除非图纸调整,本工程的合同总价不作任何

调整。

10.4 All duties, taxes and other levies payable by the Bidder under the Contract, or for any other

cause, shall be included in the prices and total bid sum submitted by the bidder. The bid

sum shall also include all known duties, taxes and other levies payable by the Owner.

投标人在本合同内或由于其它原因需支付的所有关税,纳税和其他征税应包括在由投标人提

交的单价、及投标总额中。投标总额中还应包括所有已知的应由业主支付的关税,纳税和其

它征税。

11. Currency of Bid 投标和支付的货币

11.1 The currency of the bid shall be Chinese Renminbi Yuan (RMB ¥).

投标总值必须以中华人民共和国人民币元报价。

12. Bid Validity 投标有效期

12.1 The bid shall remain valid and open for acceptance for 90 calendar days after the bid due date.

投标将保持有效至截标后90个日历日内。

13. Possession of Site 工地占有

Not Used. 未使用。

14. Bid Security 投标保证金

Please refer to preamble to bidding见投标须知前附表.

15. Alternative Offers 备选方案

15.1 The bidder shall submit a basic bid which complies fully with the requirements of the bid

documents. The bidder may, at his option, and in addition to the basic bid, offer bids

incorporating technical alternatives. Alternatives shall be specified in the letter

accompanying the Bid.

投标人应提交一份完全符合招标文件要求的基本投标件,在该基本投标件之外,投标人可按

其选择提交备选技术方案。备选方案应在附随标书的信函中说明。

15.2 In order to be considered further by the EPCM Consultant in the process of bid evaluation,

each alternative shall be accompanied by a detailed price breakdown indicating the

bidder's estimate of the additional or reduced cost in present (discounted) value to the

Owner compared to the basic Bid Sum, if the alternative offer were to be accepted by the

Owner and incorporated into the Contract. Alternative offers which are not priced, or which

are not substantiated in sufficient detail, will not be considered by the EPCM Consultant.

为了给项目顾问在评标过程中作进一步的考虑,如果备选方案被项目顾问接受并列入合同,

那末每一项备选方案应附有详细的标价细目分项,以表明投标人的备选方案与正选方案批准

估计的费用增加或减少的百分比,未报出价格的或不够详细的备选方案业主将不予考虑。

15.3 Offers of technical alternatives shall be accompanied by all information necessary for a

complete evaluation, including design calculations, drawings, method statements,

including proposed construction methodology, and specifications for materials and

workmanship where the alternative is not covered by the Specification, together with a

breakdown of the alternative prices.

技术备选方案应附有全面评价所需的全部资料,包括设计计算书,图纸、施工方法以及在技

术规范中未涉及的备选材料和工艺的技术规定,连同备选方案的价格细目。

15.4 Only those alternative offers which appear in the EPCM Consultant's sole discretion to

provide additional financial, economic or technical benefits over the basic offer will be

considered by the EPCM Consultant in bid evaluation.

只有当项目顾问个人认为以上所述备选方案在财务、经济性或技术方面比原来的基本投标提

供更多利益时,项目顾问在评标时才予以考虑。

16. Submission of questions and Pre-Bid Meetings 提交问题和标前会议

16.1 The bidder or his official representative shall submit any questions relating to the Bid

Documents or the content of the Bid per the detail requirements setted in the Preamble to

bidding.

投标人或其正式代表应根据投标须知前附表的具体要求提交与这次招标的文件内容有关的

全部问题。

16.2 If it is necessary, the bidder or his official representative shall visit the Site at a time to be

pre-arranged with the EPCM Consultant.

如有安排,投标人或其正式代表应参加项目顾问安排的现场踏勘。

16.3 The purpose of the Site visit is to allow bidders to inspect the Site to confirm existing

conditions.

现场踏勘的目的在于让投标人参观现场并充分了解现场情况。

16.4 Each bidder will be invited to attend a pre-bid meeting (If necessary) at which questions

can be asked and answers provided. Copies of the questions raised and responses given

will be furnished expeditiously to all bidders. Any modification of the bid documents listed in

Sub clause 5.1 which may become necessary as a result of the pre bid meetings shall be

made by the EPCM Consultant exclusively through the issue of an Addendum pursuant to

Clause 7.

投标人将被邀请参加标前会议,以供提出问题和得到解答(如有需要)。所提问题和所给答复,

将尽快地发送给所有参加会议的人员。由于标前会议的结果对第5.1条款下的投标文件的任

何可能需要的修改则全部由项目顾问根据条款7的规定发送补遗。

17. Format and Signing of Bids投标书的格式和签署

17.1 Those contents which has required format in tender document must be applied by the

bidders (for example blank bill of quantity), otherwise bidders’ proposal maybe as invalid.

凡招标文件有格式要求的(如空白的报价清单),投标人必须按要求的格式准备投标文件;

否则其投标可能被视为废标。

17.2 The bidder shall submit written bid proposal ( Oneoriginal and Two duplicate copies) and

electronic edition (one CD) as described in Clause 9 hereof, clearly marked ‘Original Bid’

and ‘Duplicate Bid’ as appropriate with written bid proposal. In the event of any

discrepancy between them, the Original shall prevail. Electronic edition bid proposal should

the same with written bid proposal.

投标人应按第9条的要求准备书面标书(正本1份和副本2份)及电子标书(一份CD光盘),

书面标书还应清晰地标明“正本”与“副本”的印记,当两者有矛盾时,应以正本为准。电子标书

应与书面标书一致。

17.3 The original and duplicates of the bid shall be typed or written in indelible ink and shall be

signed by a person or persons duly authorised to bind the bidder to the Contract. Proof of

authorisation shall be furnished in the form of a written Power of Attorney which shall

accompany the bid.

标书的正本与副本应使用不褪色的墨水打印或书写,并由投标人正式授权履行合同地一个或

几个人签字同时应按书面委托书的格式提交授权证明,并附于投标书中。

17.4 The complete bid shall be without alterations, interlineations or erasures, except those to

correct errors made by the bidder, in which case such corrections shall be initialled by the

person or persons signing the bid.

完整的投标书不得有任何更改,中间插入处或涂擦处,在这种情况下上述改正亦应由签署投

标书人员的首字母署名。

17.5 Only one bid shall be submitted by each bidder, not including alternative offers submitted

pursuant to Clause 15. No bidder shall participate in the bid of another for the same

contract in any relation whatsoever.

每个投标人只能提交一套投标书(不包括第15条所提的备选方案),任何投标人不能以任

何身份参加同一合同另一投标人的投标。

17.6 The bidder shall fully understand all the risks, duties and responsibilities that he shall

undertake if his bid is accepted. Consequently it shall be considered that the Bidder, upon

submitting his bid, has:

投标人应完全清楚,一旦其投标被接受时他应承担的一切风险,责任和义务,因此,当投标

人签署和提交文件时,应认为是:

(a) Carefully studied the bid documents, supplementary notices, drawings or reference

materials provided by the EPCM Consultant.

已经认真研究了项目顾问所提供的招标文件,补充通知、图纸和参考资料;

(b) Familiarised himself with and given full consideration to the natural conditions of the

Site and other conditions influential to the engineering and cost,

已经了解并充分考虑了现场的自然条件和其他影响施工或费用的条件;

(c) Confirmed that the Site construction areas shown on the drawings are adequate for

the temporary works of the Bidder,

已经确认图纸中标明为投标人临时工程提供的土地和施工场地是足够的;

(d) In the preparation of his bid, given full consideration to the difficulties and costs of

the Works.

已经对施工中的困难和费用作出了自己的判断。

(e) In the course of the implementation of the Contract, a deficiency in understanding by

the Bidder of the above mentioned matters shall not relieve him of any duty or

responsibility to fulfil and implement the Contract satisfactorily.

如果投标人未能达到上述要求;一旦中标后在履约中发生上述事项的失误,不能解除要求他

令人满意地完成本合同的责任。

17.7 If there’s any deviation between electronic bid proposal and hard copy bid proposal, the

hard copy bid proposal shall take precedence.

若电子标书与硬拷贝标书有偏差,以硬拷贝标书的内容为准。

18. Sealing and Marking of Bids 投标件的密封和标记

18.1 The Bidder shall seal the CD, original and duplicate bids each in an envelope, duly marking

the envelopes as “Original”, “Duplicate” and “CD”.

标书的CD、正本和副本应用信封分别密封,并分别标识“正本”、“副本”及“CD”。

18.3 If the envelope is not sealed and marked as instructed above, the Owner will assume no

responsibility for the misplacement or premature opening of the bid. A bid opened

prematurely for this reason will be rejected and returned to the bidder.

如果在外信封上未按上述规定密封和打上印记,则业主对于把投标文件放错地方或过早启封

19. Deadline for Submission of Bids投标书提交的截止期限

19.1 Bids proposals must be received by the Owner at the address specified above no later than

the time setted in the Preamble to bidding.The bid may be forwarded by express or

delivered in person.

投标文件应按上述规定的地址在不迟于投标须知前附表规定的时间送至上述地址,标书可以

邮寄或派人递交。

19.2 The EPCM Consultant may, at the Owner’s discretion, on giving not le ss than 48 hours

notice to all prospective bidders, extend the deadline for the submission of bids by issuing

an Addendum in accordance with Clause 7, in which case all rights and obligations of the

Owner and the bidders previously subject to the deadline shall thereafter be subject to the

new deadline as extended.

项目顾问可按照业主的决定,在不迟于截标前的48小时按第7条款所述的规定通知所有已

获得投标文件的投标人并发布补遗、延长截标日期。在这种情况下,业主和投标人对原定提

交投标文件期限所规定的有关权利和义务,相应地改为新定的延长期限为准。

20. Late Bids迟到的投标书

20.1 Any bid received after the prescribed deadline for submission of bids will be rejected and

returned unopened.

上述截止期限后收到的投标书将被拒收、原封退回。

21. Modification and Withdrawal of Bids 投标文件的修改和撤回

21.1 The bidder may modify his bid after submission, provided that the modification or notice of

withdrawal is received in writing by the EPCM Consultant prior to the prescribed deadline

for submission of bids.

在截止投标之前,当项目顾问收到修改或撤回标书的书面通知的情况下,方允许投标人修改

或撤回已经提交的投标文件。

21.2 The bidder's modification shall be prepared, sealed, marked and despatched in

accordance with the provisions for the submission of bids.

投标人修改或撤回标书的通知应按提交投标文件的同样规定进行编制、密封、印记和投送。

21.3 Subject to Clause 25, no bid shall be modified subsequent to the deadline for submission

of bids.

根据第25条规定,在提交投标文件的截止期限之后,不允许再予以修改。

PART D) BID OPENING AND EVALUATION 开标与评标

22. Process to be Confidential过程保密

22.1 After bid proposal opening, Information relating to the examination, clarification, evaluation

and comparison of bids and recommendations concerning the award of contract shall not

be disclosed to bidders or other persons not officially concerned with such process.

在开标以后,有关对投标文件的审查、澄清、评价和比较等资料以及授予合同地建议均不得

泄露给各投标人或与此项工作无关的任何人员。

22.2 Any effort by a bidder to influence the EPCM Consultant or the Owner in the process of

examination, clarification, evaluation and comparison of bids and decisions concerning

award of contract may result in the rejection of his bid.

投标人在投标文件的审查、澄清、评审和比较以及对有关授予合同作出决定的过程中企图给

项目顾问或业主施加任何影响将会导致拒绝其投标。

23. Clarification of Bids投标书的澄清

23.1 To assist in the examination, evaluation and comparison of bids, the EPCM Consultant

may ask bidders individually for clarification of their bids, including breakdowns of prices.

The request for clarification and the response shall be in writing.

项目顾问可个别地要求投标人澄清投标书中的问题,包括单价的细目分项,籍以协助对投标

书进行审查,评审和比较,要求澄清和答复必须用书面形式。

24. Determination of Responsiveness 响应性的确定

24.1 Prior to the detailed evaluation of bids, the EPCM Consultant will determine whether each

bid is substantially responsive to the requirements of the bid documents.

在对投标书详细评审之前,项目顾问将决定每个投标书是否响应了招标文件的要求。

24.2 For the purpose of this Clause, a substantially responsive bid is one which conforms to all

the terms, conditions and specifications of the bid documents without material deviation or

reservation. A material deviation or reservation is one which affects in any substantial way

the scope, quality or administration of the Works, or which limits in any substantial way,

inconsistent with the bid documents, the Owner's rights or the bidder's obligations under

the Contract, and the rectification of which deviation or eservation would affect unfairly the

competitive position of other bidders offering substantially responsive bids.

本条款的作用是:一份真正响应的投标书是符合招标文件规定的所有项目条件和规范而无实

质性的偏差或保留。一个实质性的偏差或保留是指以任何方式影响工程范围、质量或管理、

或者与招标文件不一致从而限制了本合同所规定的业主的权利或投标人的义务;同时,这些

偏差或保留的修正将会不公正地影响其他提供真正响应招标文件要求的投标人的竞争地位。

24.3 The EPCM Consultant may waive any minor informality or non conformity or irregularity in

a bid which does not constitute a material deviation.

项目顾问舍弃标书中一些微小的不正规的或不相称的或不正常的而且不构成实质性的偏差。

24.4 If a bid is not substantially responsive to the requirements of the bid documents, it will be

rejected by the EPCM Consultant and may not subsequently be made responsive by

correction of the nonconformity.

如果投标书不能真正响应招标文件的要求,项目顾问将拒绝其投标,并且不再要求其对错误

纠正从而具有响应性。

25. Correction of Errors错误的更正

25.1 Bids determined to be substantially responsive will be checked by the EPCM Consultant

for any arithmetical errors in computation and summation. Errors will be corrected by the

EPCM Consultant as follows:

已被确定为真正响应招标文件要求的投标书,将由项目顾问核对其计算和总额是否有运算错

误,错误应按下列规定更正:

(a) Where there is a discrepancy between amounts in figures and in words, the amount

in words will normally govern, unless it is clear from the context that the amount in figures

is correct;

数字和文字表示的总额有矛盾时,将以文字表示的总额为准,除非已从上下文中弄清楚数字

表示的总额是正确的;

(b) Where there is a discrepancy between a unit rate and the total amount derived from

the multiplication of the unit rate and the quantity, the unit rate as quoted will normally

govern unless, in the opinion of the EPCM Consultant, there is obviously a gross error in

the unit rate; in which event the total amount as quoted will govern and the unit rate will be

corrected.

在单价和总价之间,由于乘积转换发生不符时,通常以单价为准,除非,项目顾问认为单价

25.2 The amount stated in the Form of Bid will be adjusted by the EPCM Consultant in

accordance with the above procedure for the correction of errors and, with the concurrence

of the bidder, shall be considered as binding upon the bidder. If the bidder does not accept

the corrected amount of the bid, his bid will be rejected and the bid security may be

forfeited.

业主按上述错误的更正方法对列于投标书表格中地总额作出调整,在投标人同意的情况下应

视作为投标人有约束力,如果投标人不接受上述对错误的更正,则拒绝其投标且投标保证金

可能被没收。

26. Evaluation and Comparison of Bids投标书的评审和比较

26.1 The EPCM Consultant will evaluate and compare only those bids determined to be

substantially responsive to the requirements of the bid documents in accordance with

Clause 25.

项目顾问将按本文第25条款的规定,对认为真正响应招标文件要求的投标书进行评审和比

较。

26.2 In evaluating bids, the EPCM Consultant will determine for each bid the Evaluated Bid

Price by adjusting the bid price as follows:

在评标时,业主将按下述条件对投标价进行调整以确定每一投标人的评价估价:

(a) making any correction for errors pursuant to Clause 25;

按第25条款对错误进行更正;

(b) making an appropriate adjustment for any other acceptable quantifiable variations,

deviations or alternative offers not reflected in the bid price or in the above mentioned other

adjustments.

在投标价格中或在上述其他调整范围内未反映的其他任何可接受的量的变化,差异或备选方

案可作适当的调整.

(c) such other factors as the EPCM Consultant considers may have a potentially

significant impact on contract execution, price and payments, including the effect of items

or unit rates in the bid that are unbalanced or unrealistically priced.

诸如项目顾问认为对合同的实施,报价以及支付等方面有潜在显著的影响等其他因素,包括

投标书中各项目的实施或单价里有不平衡或不现实的。

26.3 The Owner reserves the right to accept or reject any variation, deviation or alternative offer.

Variations, deviations, alternative offers and other factors which are in excess of the

requirements of the bid documents or otherwise result in the accrual of unsolicited benefits

to the Owner will not be taken into account in bid evaluation.

业主保留有接受或拒绝任何变动,差异或备选方案的权利,凡超过招标文件要求的或其他主

动向业主提供得益的变化,差异和备选方案以及其他因素在评标时不予考虑。

26.4 The EPCM Consultant will determine to his satisfaction, whether the bidder, whose

submitted bid has been evaluated as having the lowest Bid Sum and has been determined

to be responsive:

(a) is qualified to satisfactorily perform the Contract, and

PART E) AWARD OF CONTRACT 合同的授予

27. Award Criteria授予合同的基准

27.1 Subject to Clause 29, the Owner will award the Contract to the bidder whose bid has been

determined to be substantially responsive to the bidding documents and who has offered

the most attractive Evaluated Bid Price pursuant to Clause 26, provided further that the

bidder has the capability and resources to carry out the Contract effectively and meets all

necessary requirements to the satisfaction of the Owner.

根据第29条款,业主将合同授予已经证明其标书是真正响应招标文件要求的,其报价按第

26条款的规定,经过评审后是有吸引力的标价,而且有能力和资源有效地实施本合同与符合

全部要求达到业主满意的投标人。

28. Owner’s Rights业主的权利

28.1 Notwithstanding Clause 29, the Owner reserves the right to accept or reject any bid, and to

annul the bidding process and reject all bids, at any time prior to award of contract, without

thereby incurring any liability to the affected bidder or bidders or any obligation to inform

the affected bidder or bidders of the grounds for the Owner’s action.

尽管有第29条款的规定,业主在授予合同之前的任何时候,保留有接受或拒绝任何一份投

标书和宣布投标无效以及否决所有投标的权利,而不因此对受影响的投标人承担任何责任,

也不因把业主采取这些行动的理由通知受影响的投标人而承担任何义务。

28.2 The Owner may, at the time of award of the Contract and at any time thereafter, vary the

quantities of work required under the Contract. For any such variation an adjustment shall

be made to the Contract Price in accordance with the Conditions of Contract.

业主在授予合同时,或者以后的任何时候,可以变更合同中所要求的工作数量。并且,对这

些工程量变更应根据合同条件,对合同价格进行调整。

29. Notification of Award授标通知

29.1 Prior to the expiration of the period of bid validity prescribed by the EPCM Consultant, the

Owner will notify the successful bidder in writing that his bid has been accepted. This letter

(hereinafter and in the Conditions of Contract called the "Letter of Acceptance") shall name

the sum which the Owner will pay to the Bidder in consideration of the execution of the

Works by the Contractor as prescribed by the Contract (hereinafter and in the Conditions of

Contract called the "Bid Sum").

在项目顾问规定的投标有效期满之前,雇主将以书面的方式通知中标的投标人,其投标已被

接受,在该封信(下文和合同条件中被称为“授标信”)中应列出业主将付给投标人由业主在

29.2 The notification of award will constitute the formation of the Contract.

29.3 The Owner will promptly notify the other bidders that their bids have been unsuccessful.

30. Signing of Agreement 签订协议

30.1 Within one month of issuing the Letter of Acceptance the Owner will make arrangements

for the signing of two copies at least of the Form of Agreement, one copy of which will be

given to the Bidder. However, as stated in Clause 29 above, the Letter of Acceptance shall

constitute the formation of the Contract and the Contract will be deemed to commence

from that date.

在发出授标信后一个月内,业主将安排签订至少二份协议书格式,其中一份给中标人。然后

31. Notice to Proceed 开工令

31.1 After the Owner has issued the Letter of Acceptance the EPCM Consultant will issue the

Notice to Proceed in accordance with the Conditions of Contract. The date of

commencement of the Contract will be specified in the Letter of Acceptance.

在授标信由业主发出以后,项目顾问将根据合同条件发布开工令,开工日期将在授标信中具

体规定。

PART F) TIME FOR COMPLETION 完工时间

32. Completion of Works工程完工

32.1 The works shall be completed in separable parts as detailed in the Technical Tender

Document and in accordance with the Conditions of Contract.

所有工作须按下述技术招标文件要求及合同条件分块完成。

33. Safety 安全

Safety is of prime concern during the execution of this Contract. The bidder is required comply with the safety clauses as detailed in the Tender Documents. The bidder is to make sufficient allowance in his lump sum price to comply with these requirements.

在本合同履行过程中安全是首要关注点,投标人必须满足招标文件中详细规定的所有安全条款,投标人在其投标包干总价中为满足相应要求留出充足的费用空间。
