一、双方本着合法、公平、平等自愿、协商一致、诚实守信的原则和友好合作精神,自愿签订本合同并保证认真履行合同中约定的各项义务。

Both Party agree to sign this contract and pledge to fulfill all the obligations stipulated, in line with the principles of legality, justice, equality, voluntariness and mutual agreement.

二、合同期自2013年月日起至年月日止。(到中国后签) The employment term is one year when he arrives China, lasting from 27th, Dec 2013 to 26th, Dec 2014.

三、受聘方工作地点:广州环市东路326号亚洲国际大酒店6楼

Place: 6F, Asia International Hotel, No326. Huan Shi Dong Rd,Guang Zhou 四、受聘方工资为美金/月,月薪周期为每月1日至31日,发放周期为每月10日结算上月薪资。

The employee’s salary is $2000/month. The calculating date per month is from the first day to the last day of one month. The salary will be paid on the 10th every month. The transportation fee is 600RMB per month.

五、受聘方的工作任务:

Employee’s job content:

1、负责西餐后厨的食品,机器及工具的管理和维护。

Be responsible for managing and maintaining the foods, machines and tools for cooking in his own kitchen and other kitchens.

2、负责西餐食品、质量、环境与行业标准接轨及每日正常协助西餐总厨出品营业。Be responsible for making the western restaurant’s food quality and environment to reach the field’s standard and doing his work everyday plus cooking with executive chef.

六、受聘方的义务:

Employee’s Duty:

1、遵守聘方国家法律法规和宗教信仰及公司管理规章制度。

The employee should abide by China laws, decrees, religion beliefs and rules and regulations of the company.

2、遵守职业操守和规程。

The employee should abide by the occupation ethics and standards.

3、提供办理签证应提供的法律文件或证件资料。

The employee should provide the documents including the law files or proving files when deal with the visa.

4、提供在聘方医疗机构体检证明。

The employee should supply the healthy prove issued by the hospital in China.

5、接受聘方的工作安排、业务指导、检查和评估。

The employee should receive the company’s working arrangement, guide,supervision and evaluation.

6、未经聘方同意不得兼任与聘方无关的其他劳务。

The employee cann’t find other jobs without the company’s permissi on.

7、禁止带异性来公司宿舍过夜,无酗酒、吸毒、赌博等不良生活习惯。

Fully prohibited to bring females to your room that belong to the company and no bad living habits such as alcohol-abusing, drugs and gambling etc.

七、受聘方承担的责任

Employee’s responsibility

1、承担因个人资料不全或身体状况等其他原因造成的无法办理合法用工手续,给聘方带来的损失责任。

The employee should be responsible for the lose caused by the lack of personnel files or in bad body condition or other reasons to get the legal working certificates.

2、承担违约而给聘方经营带来的损失。

The employee should pay the lose caused by violating the contract. 3、损失范围:聘方办理受聘方商务签证的费用、办理工作签证的费用、办理签证公关费用、来往交通费用、酒店住宿费用、无法经营而停业或客户群流失而产生的营业额损失(不限以上)。

The scope of loss: business visa fee, working visa fee, visa fee,

transportation fee, accommodation cost and loses for not running the restaurant(no limit).

4、受聘方必须服从公司相关领导和直属经理的管理,否则,经理有权减发工资或辞退。

The employee must obey the related leaders and direct managers’s order, or, the manager has the right to deduct the salary or dismiss the employee.

5、承担工作重大失误或违犯受聘方所了解的中国法律所带来的损失赔偿。The employee should pay the lose caused by his major mistake or violating the Chinese laws that he knows.

八、聘方的义务:

Employer’s duty:

1、向受聘方介绍中国有关法律、法规和聘方有关工作制度以及有关外国人员的管理规定。

Introduce the Chinese laws, decrees and company regulations, especially for the foreign clients.

2、对受聘方的工作进行指导、检查和评估。

Check, guide and evaluate the employee’s job.

3、向受聘方提供必要的工作和生活条件。

Supplying the basic working and living conditions.

4、配备受聘方合作共事人员。

Employ co-workers for the employee.

5、按时支付受聘方的报酬。

Pay on time as agreement reached by two parties.

6、提供受聘方独立住宿房间。

Supply independent living room.

7、提供受聘方一日三餐。

Provide the employees breakfast, lunch and dinner.

8、提供受聘方合同期内一次性1个月带薪假期。

One month fully paid salary vacation should be arranged during the contract period.

9、提供受聘方合同期内回国往返机票1次(经济舱)。

Supply round air-ticket (economy class) one time during the contract period.

10、办理受聘方在工作地的工作签证及签证费用。

Be responsible for applying for the working visa and working visa fee.

11、提供受聘方在工作期间意外伤害商业保险。

Supply employee business insurance for accident injury during the working time.

12、提供受聘方在华期间法律咨询。

Supply for the service of law council during the contract period. 九、Supplementary Terms

1. 一周轮息一天

One day off a week in turn.

2.工作时间为9小时每天。

working hours: 9 hours a day

十、合同的变更、解除和终止:

Contract’s change, cancellation and termination.

双方应信守合同,未经双方一致同意,任何一方不得擅自更改、解除和终止合同。经当事人双方协商同意后,可以变更、解除和终止合同。在未达成一致意见前,仍应当严格履行合同。

Both of the party should obey the contract strictly. Except mutual agreement, no any behaviour to change, cancel and terminate the contract without permission. Both party should abide the contract strictly before reaching the agreement.

十一、续约

Renewing the Contract

1、聘用双方若希望与对方续签合同,必须在本合同期满30天前向另一方提出,经双方协商同意后签订新合同;

The request must be told before 30 days when the contract will be finished, if any party wants to renew the contract. The new contract can be signed after tw o party’s consultation.

2、聘方若无意与受聘方续签合同,合同期满即自行失效,无须提前告知受聘方。The contract shall be terminated without noticing to the employee when the contract expires, if the employer does not want to renew the contract. 十二、争议解决

Solving the issues

当事人双方发生合同纠纷时,尽可能通过协商解决。若协商无法达到一致意见,可在争议产生后60天内向劳动仲裁部门申请仲裁。如发生纠纷的任何一方对仲裁结果不服,可直接向地方法院提起诉讼,由法院按规定程序判决。

本合同于2014年月日在中国广州签订,一式两份,每份均用中文和英文写成,两种文本同等作准。

When issue occurs, it should be solved through consultation.

If the negotiation does not work, the issue can be submitted to the labor arbitration department for arbitration within 60 days.

If any party disagrees with the result of arbitration, he can sue to the local court. The contract is written in duplicate in english and Chinese in Guang Zhou, China. The two copies are equally authentic.
