April, 2004, European Union published the Regulation (EC) No 850/2004 on persistent organic pollutants in its Official Journal of the European Union. Then, the regulation was amended by (EU) No 756/2010 and EU) No 757/2010 in 2010, (EU) No 519/2012 in 2012. On 14 November 2015, Regulation (EU) 2015/2030 which amends the conditions of the prohibition on short-chain chlorinated paraffins, SCCPs, was published. The European Commission Regulation (EU) 2016/293 was published on 2March 2016 and the amendment added Hexabromocyclododecane (HBCDD) to Part A of Annex I,

What are persistent organic pollutants (POPs)?
Persistent organic pollutants (POPs) are chemical substances that persist in the environment, bioaccumulate through the food web, and pose a risk of causing adverse effects to human health and the environment. This group of priority pollutants consists of pesticides (such as DDT), industrial chemicals (such as polychlorinated biphenyls, PCBs) and unintentional by-products of industrial processes (such as dioxins and furans), SCCP and HBCDD.

HBCDD POPs
The European Commission Regulation (EU) 2016/293 was published on 2 March 2016 as an amendment to Regulation (EC)850/2004 on Persistent Organic Pollutants (POPs). The amendment to the POPs Regulation will be effective from 22 March 2016.The amendment added Hexabromocyclododecane (HBCDD) to Part A of Annex I, which prohibits the production,placing on the market and use of the listed substances on their own, in mixtures or as constituents of articles.The common uses include as a flame retardant which are allowed to be present in articles if the concentration is less than 100mg/kg by weight. As HBCDD is also one of the substances listed on the REACH Annex XIV (i.e. the Authorisation List), this new amendment to the POPs regulation has aligned the Authorisation and prohibition conditions under both Regulations.
HBCDD REACH 14 POPs
In addition, there are several specific exemptions conditions including, but not limited to, HBCDD in substance or mixture or as a constituent in expanded polystyrene articles and extruded polystyrene articles. Articles containing HBCDD as a
constituent of such articles and are already in use before or on 22 March 2016 may continue to be used and further placed on the EU market.
