PAYMENT: Payment shall be made by T/T with 100% the total value to be paid against the presentation of the invoice
and other shipping documents.
Any balance between the provisional payment and the
final cargo value shall be settled by the owing party in
net cash via telegraphic transfer within 3 (three)
working days after the final price and final assays by
CIQ is known..
100% payment against Seller’s presentation of the
following shipping documents:
1)Original shipped on board Bills of lading, showing
“Freight Prepaid”,blank endorsed, made out to
order.
2)Seller’s commercial invoice
3)Packing list.
WEIGHT AND SAMPLING: weighing and sampling and
determination of the chromite content shall be
carried out at discharging port or smelter by CIQ,
in line with international practices as agreed
between Seller and Buyer.
Weighting at discharging port or smelter shall be
performed by scale with the presen ce of Seller’s
and Buyer’s representatives
FORRCE MAJEURE: Seller shall not be liable foe any delay or
failure to make shipment or delivery under this
contract caused by or resulting from any
contingencies or causes beyond Seller’s control
or beyond the control of their suppliers or the
carrier of the material including but not limited
calamities of nature, war, strikes, riot, embargoes,
delays of carriers, Labor difficulties and any
other similar occurrences whether legal or illegal. Arbitration: Any controversy or claim which cannot be settled
amicably between Buyer and Seller shall be
submitted to China International Economic and
Trade Arbitration Commission Shanghai
Sub-commission for arbitration which shall be
conducted in accordance with the commis sion’s
arbitration rules in effect at the time of applying
for arbitration. The arbitration award is final and
binding upon both parties.
