湖北省水污染防治条例（全文） 湖北省水污染防治条例 第一章总则 第一条为了防治水污染，保护和改善水环境，保障用水安全，推进生态文明建设， 促进经济社会可持续发展，根据《中华人民共和国环境保护法》、《中华人民共和国水污染防治法》、《中华人民共和国水法》等有关法律、行政法规，结合本省实际，制定本条例。 第二条本条例适用于本省行政区域内的江河、湖泊、水库、运河、渠道、塘堰、 水井等地表水体和地下水体的污染防治。 第三条水污染防治坚持预防为主、严防严治、综合治理、公众参与、污染者担责 的原则。 第四条县级以上人民政府应当对本行政区域内的水环境质量负责，将水污染防治工 作纳入国民经济和社会发展规划，建立财政资金和社会资金相结合的多元化资金投入和保障机制，采取有效措施，改善水环境质量。 第五条实行水污染防治政府行政首长负责制、目标责任制和水环境损害责任终身追 究制。 县级以上人民政府应当每年向本级人民代表大会或者其常务委员会报告本行政区域的水污染防治工作。 第六条任何单位和个人都有保护水环境的义务，享有获取符合安全、卫生标准的生 产生活用水的权利。 县级以上人民政府及其有关部门对在水污染防治工作中做出显著成绩的单位和个人给予表彰和奖励。 第二章政府职责 第七条县级以上人民政府应当依法制定本行政区域水污染防治规划和年度实施计划，明确水污染防治目标，保证本行政区域水体符合规定的水环境质量标准。 乡镇人民政府、街道办事处根据法律法规的规定和上级人民政府的要求，开展有关水污染防治工作。

第八条省人民政府应当根据国家水环境质量标准、水污染物排放标准以及本省主要 流域、地区水环境现状和经济、技术条件，对国家水环境质量标准和国家水污染物排放标准中未作规定的项目，制定本省水污染物排放标准，严格控制水污染物排放。 对环境敏感区、生态脆弱区、水环境容量不足的区域，省人民政府应当制定严于国家标准的地方水污染物排放标准，实行水污染物排放总量控制。 第九条县级以上人民政府应当建立健全基层环境监测预警体系和环境监察执法体系，加强水环境保护执法队伍建设，组织开展教育培训，规范执法行为，提高基层环境保护执法能力和执法水平。 第十条县级以上人民政府环境保护主管部门对水污染防治实施统一监督管理，具体 履行下列职责： (一)贯彻实施有关水污染防治的法律法规、政策措施; (二)会同有关部门编制水污染防治规划; (三)依法拟定水环境功能区划和地方水污染物排放标准; (四)会同有关部门编制饮用水水源保护区的划定方案; (五)建立水环境监测网络，统一监测和定期发布水环境质量信息; (六)编制水污染突发事件应急预案，调查处理水污染事件; (七)依法开展水环境保护监察执法; (八)法律法规规定的其他职责。 第十一条县级以上人民政府对水污染防治负有监督管理职责的有关部门，依照规定 履行下列职责： (一)水行政主管部门负责编制与调整水资源保护规划和水功能区划，提出水体限制排 污总量意见，审批新建、改建、扩建进入地表水体的排污口的设置，监测、分析水功能区的水质状况; (二)农业主管部门依法管理农药、化肥等农业投入品的使用，指导畜禽、水产养殖的 水污染防治，推广测土配方施肥，发展生态农业，防治农业面源污染; (三)城乡建设相关主管部门依法做好城乡规划，负责城乡垃圾处理，城镇污水集中处 理设施及配套管网规划、建设和运营管理;
